These regulations were scheduled to go into effect on August 1, 2024.
Since April 19, 2024, 26 states have filed 8 federal lawsuits, asking courts to block the 2024 Regulations. Each lawsuit resulted in the requested injunctive relief. While the lawsuits did not primarily focus on the disciplinary process, the granted injunctions have successfully blocked the
entire set of regulations.
August 16, 2024 – The United States Supreme Court issued a ruling leaving these injunctions intact. The Government argued to separate the challenged provisions from the remainder of the Regulations, particularly regarding the Title IX disciplinary process. However, the Court noted:
“On this limited record and in its emergency applications, the government has not provided this court a sufficient basis to disturb the lower courts’ interim conclusions that the three provisions found likely to be unlawful are intertwined with and affect other provisions of the rule.”
As a result, the 2020 Title IX Regulations will remain in effect in Ohio and the 25 other states while the lawsuits progress. This decision is welcomed by due process advocacy groups, as the 2020 Regulations ensure important rights for both accusers and the accused, fostering a fairer and more trustworthy process for all parties involved.
