Possession & Receipt of Child Pornography

The defendant was charged with multiple offenses involving the possession and dissemination of child pornography and was facing over twenty years in prison in the Cuyahoga County Court of Common Pleas. Friedman, Nemecek & Long secured a resolution that albeit favorable, still involved a presumption of prison based on Ohio Sentencing laws. After a lengthy sentencing presentation involving several witnesses including an expert witness in the field of Sexology from Los Angeles, California, the Judge found that the presumption of prison had been overcome and sentenced the defendant to Community Control Sanctions over the objection of the State.
