Law enforcement officer was charged with Rape and kidnapping in the Summit County Court of Common Pleas. The State of Ohio alleged that while working a secondary security detail, the Defendant sexually assaulted and kidnapped the accuser in an unmarked police vehicle. At the jury trial, the State relied upon testimony from the accuser and cellular positional data when presenting their case. Cross-examination of the accuser and investigating agents revealed faulty interpretation of evidentiary data and lack of truthfulness in the entire claim. The jury rendered a verdict of Not Guilty to all charges. The State of Ohio, in its pursuit of the Defendant, then indicted him on 10 felony counts of improperly using the OLEG system by conducting self-searches. After years in court while combatting all indicted counts, the State of Ohio conceded that the case could no longer proceed in good faith due to the clear statutory interpretation. Upon Motion by the State of Ohio, the remainder of the prosecution was dismissed.
