0:00 so as a trial nears a client commonly 0:04 asks should I try the case to a jury or 0:07 should I try it to the bench which means 0:09 have the judge decide the case and that 0:12 is a question that needs to be answered 0:14 uh on a case-by Case basis depends what 0:16 the issues are depends who the judge is 0:19 um an issue could be a complex issue it 0:22 could be something that the nature of 0:24 the allegation is so egregious there's 0:26 just a lot of different factors that we 0:28 have to think about so uh as we get 0:31 closer to the case as we learn what the 0:33 facts are uh as we know what our defense 0:37 is going to be that's when the decision 0:39 is made it's not a decision that could 0:41 be made very early on in the case so uh 0:43 again what you want is your Council to 0:46 go through everything and then put out 0:48 before you on the table uh what all the 0:50 defenses are what the allegations are 0:52 how they think it's going to uh appeal 0:55 to uh jurors of one's peers or to a 0:59 judge who may heard that subject matter 1:01 many times over uh please feel free to 1:03 call us a Freeman and Fry we' be happy 1:05 to sit down with you go over all your 1:07 options explain to you again uh the 1:11 difference between a bench trial and a 1:13 jury trial whether it be at the 1:14 municipal level state level or in 1:16 federal courts
