Assault Crimes: As Defined in the Cleveland Revised Code
There are several different levels of assault charges, all defined in the Cleveland Revised Code (ORC). Simple assault is defined in ORC § 2903.13 as knowingly causing or attempting to cause physical harm to another, or another’s unborn or recklessly causing physical harm to another or to a woman’s unborn child. The offense can be filed as a misdemeanor in the first degree or as a fourth-degree felony, depending on what is alleged to have taken place.
A charge of negligent assault can be filed against you if it is alleged that you caused another person harm through the negligent use of a deadly weapon. Negligent assault (§ 2903.14) is a misdemeanor. Aggravated assault (§ 2903.12), which is committed in “sudden passion or in a sudden fit of rage,” is a felony offense, as is felonious assault (§ 2903.11) involving a deadly weapon.
